UnclutterAI Terms of Service

1. Acceptance of Terms

 

By accessing or using the UnclutterAI application, website, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and the UnclutterAI Privacy Policy. If you do not agree to these Terms, do not use the Service.

 

2. Eligibility and User Accounts

 

• Eligibility: You must be at least 13 years of age (or the minimum legal age required in your country to consent to the use of an online service) to use the Service.

• Account Responsibility: You are responsible for all activities that occur under your account and for maintaining the security of your password. UnclutterAI reserves the right to terminate accounts that are inactive, or violate these Terms.

 

3. License and Use of the Service

 

• Limited License: UnclutterAI grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

• Prohibited Conduct (Mandatory Compliance): You agree not to use the Service to:

  • Transmit unlawful, harmful, defamatory, or abusive content.

  • Infringe upon the intellectual property, privacy, or proprietary rights of others.

  • Introduce viruses, malware, or other harmful code.

  • Bypass or breach any security or authentication measures.

4. Intellectual Property

 

• UnclutterAI Property: All rights, title, and interest in and to the Service, including all text, graphics, logos, and the AI models used, are the exclusive property of UnclutterAI and its licensors.

• User Content: You retain ownership of any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant UnclutterAI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute the User Content solely for the purpose of operating, improving, and promoting the Service.

 

5. Digital Currencies and Token Economy (UCT)

 

• UCT Token: The Service may involve earning and spending UCT tokens ("UCT") for advanced features. UCT are utility tokens within the UnclutterAI ecosystem and are not securities, investment contracts, or financial instruments.

• No Monetary Value Guarantee: UCT has no inherent monetary value outside of the Service. UnclutterAI makes no promise or guarantee of the UCT's future value or tradability.

• Token Use: UCT are used solely to unlock premium features and gamified progression within the Service.

 

6. Subscription, Payments, and Fees

 

• Freemium Model: Core features are available for free. Advanced features are available through subscription or UCT token redemption.

• Billing: All purchases (subscriptions or tokens) are processed through the respective third-party platform (e.g., Apple In-App Purchase, Google Play Billing, etc.). You must abide by the payment terms and conditions of that third-party platform.

• Refunds: Refund policies are governed by the respective platform (Apple, Google, etc.). UnclutterAI will comply with the refund policies mandated by these platforms.

 

7. Privacy and Data Protection (Critical for Platforms)

 

Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms. The Privacy Policy details how we collect, use, and share your data, including data used for personalized AI features, advertising (if applicable), and compliance with global privacy laws (GDPR, CCPA, etc.).

• Data Minimization: We only collect and process data necessary to provide and improve the Service.

• User Control: We provide mechanisms for you to access, correct, delete, or port your data as required by applicable laws.

 

8. Third-Party Links and Services

 

The Service may contain links to third-party websites or services. UnclutterAI is not responsible for the content, accuracy, or practices of any third-party websites or services. Your use of such services is at your own risk.

 

9. Termination

 

UnclutterAI may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms or the terms of any third-party app store.

 

10. Disclaimer of Warranties

 

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. UNCLUTTERAI MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

 

11. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNCLUTTERAI BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

 

12. Governing Law and Dispute Resolution

 

These Terms shall be governed by the laws of New York State, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration in Saratoga Springs, NY, or in the jurisdiction mandated by the platform providing the service.

 

13. Changes to Terms

 

UnclutterAI reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
